Terms of Service

The Service is for adults only. You must be at least 18 years old to create an account, and you must give an accurate date of birth. Accounts belonging to anyone under 18 are removed. See our Child Safety Standards.

You must also not be barred from using the Service under the laws of your country, and must not have been previously removed from it.

• One account per person. Accounts are personal and non-transferable.
• Keep your password confidential. You are responsible for activity on your account.
• Give accurate information about yourself and keep your profile truthful. Impersonating another person is not permitted.
• You can delete your account at any time.

You agree not to use the Service to:

• post or send sexually explicit content, nudity, or content that sexualises anyone;
• harass, threaten, stalk, bully, defame or intimidate anyone, or incite others to;
• post hateful content, or attack anyone on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation or age;
• solicit or advertise commercial sexual services, or engage in human trafficking of any kind;
• solicit money or financial information from other users, or run scams, phishing or romance fraud;
• advertise, spam, or promote another product, service or platform;
• post another person’s private information, or share private messages, photos or videos you received on the Service without consent;
• post anything unlawful, or any content involving minors as described in our Child Safety Standards;
• use bots, scrapers or automation against the Service, attempt to circumvent its security, or reverse engineer it.

You keep ownership of the photos, videos, text and other content you post. By posting it you grant KissnTells a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content for the sole purpose of operating and providing the Service. That licence ends when you delete the content or your account, except for copies already shared with other users and for the limited records described in our Privacy Policy.

You are responsible for what you post, and you confirm you have the right to post it.

Every profile, message, reel and room in the Service can be reported from within the app, and every user can be blocked. We review reports and may, at our discretion, remove content, restrict features, suspend an account or terminate it, with or without notice, depending on the severity of the breach.

Serious breaches, in particular anything involving a minor, result in immediate termination and are reported to the appropriate authorities.

• Coins are a virtual item, not money. They have no cash value, cannot be exchanged for cash, and cannot be transferred to another person or account.
• Coins are bought through Google Play or the Apple App Store, and those purchases are governed by the store’s terms as well as these. We do not process or store your card details.
• Coin purchases are final and non-refundable, except where a refund is required by law or granted by the store under its own refund policy. Refund requests go to Google or Apple, not to us.
• Coins buy access to features inside the app. Prices, and what a given number of coins buys, can change. Changes are not applied retroactively to coins you have already spent.
• Unspent coins are lost if you delete your account, or if we terminate it for a breach of these Terms.

KissnTells does not run background or criminal record checks on its users. We cannot and do not verify that anyone is who they claim to be. You are solely responsible for your interactions with other users, online and in person.

Take sensible precautions. Meet in public, tell someone where you are going, never send money to someone you met on the Service, and report anyone who makes you uncomfortable.

Our Privacy Policy explains what we collect and what we do with it, and forms part of these Terms.

We may change, suspend or discontinue any part of the Service. We may also update these Terms. If we make a material change we will give notice in the app or by email before it takes effect, and continuing to use the Service after that means you accept the updated Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to harm. Sections 4, 6, 7, 11 and 12 survive termination.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that you will find a match.

To the fullest extent permitted by law, KissnTells is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of your use of the Service. Our total liability to you for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) US$100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in North Carolina, except where the law of your country of residence gives you the right to bring proceedings elsewhere.
